Terms of Service

These Terms of Service ("Terms") govern your access to and use of inGenHost services. By purchasing, accessing, or using our services, you agree to be bound by these Terms.

1. Agreement & Definitions

These Terms of Service (the “Agreement”) are between inGenHost (“Company,” “we,” “us,” “our”) and the person or entity purchasing, accessing, or using our services (“Customer,” “you,” “your”). Use of the services constitutes acceptance of this Agreement.

“Services” include web hosting, reseller hosting, domain registration and transfer, DNS, SSL, email, website tools, and related products or support we provide via our platform and client portal.

2. Services

  • Services are provided on an as‑is and as‑available basis subject to this Agreement.
  • We may modify, enhance, discontinue, or impose limits on any Service at any time. Material adverse changes will be communicated via the client portal or email.
  • Beta or trial features may be offered without warranties and may be discontinued at any time.

3. Eligibility & Account

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to open an account.
  • You agree to provide accurate registration, billing, and contact information and keep it current.
  • You are responsible for safeguarding credentials and all activity under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use Policy (AUP)

You agree not to use the Services for any unlawful, harmful, or abusive purpose, including without limitation:

  • Hosting or distributing content that is illegal, defamatory, obscene, exploitative, or infringes third‑party rights.
  • Sending unsolicited bulk or commercial emails, phishing, fraud, or deceptive practices.
  • Hosting malware, botnets, crypto‑mining without permission, or attempts to compromise security, availability, or integrity of our infrastructure.
  • Resource abuse (e.g., excessive CPU/IO/network) that degrades the experience of other users.

We may suspend or terminate Services for AUP violations. We may report illegal activity to authorities.

5. Payments, Renewals & Refunds

  • Services are billed in advance on a recurring basis (monthly, annually, or as otherwise stated at checkout).
  • Prices and fees are subject to change. Renewals are charged at the then‑current rate.
  • Failure to pay may result in suspension and eventual deletion of data. Reconnection fees may apply.
  • Refunds: Domain registrations/transfers/renewals and SSL certificates are non‑refundable. Hosting plans may offer a money‑back period if stated on the product page; abuse or policy violations void eligibility.
  • All taxes, duties, and government charges are your responsibility.

6. Service Levels, Availability & Maintenance

  • We target 99.9% uptime, excluding scheduled maintenance, emergency maintenance, force majeure, third‑party outages, and events beyond our reasonable control.
  • Maintenance windows will be announced when practicable. Emergency work may occur without prior notice.
  • Credits, if any, are described in our SLA (if provided) and are the sole remedy for uptime shortfalls.

7. Data, Security & Backups

  • You are responsible for maintaining independent backups of your content. Any backups we provide are a convenience only and are not guaranteed.
  • We implement reasonable technical and organizational safeguards but cannot guarantee absolute security.
  • You must implement application‑level security, keep CMS/plugins updated, use strong passwords, and follow best practices.

8. Domain Names

  • Domain services are subject to ICANN policies, registry rules, and our Registrar’s terms. You are responsible for ensuring accurate WHOIS and timely renewals.
  • Once registered or renewed, domains are generally non‑refundable. Redemption and restore fees may apply after expiration.

9. Email, Anti‑Spam & Resource Fair Use

  • Bulk email sending from shared hosting is restricted; use dedicated email services for campaigns.
  • We may rate‑limit or block traffic that threatens platform stability or reputation (e.g., spam, compromised accounts).
  • Mailbox and attachment size, hourly send limits, and mailing list rules are enforced per plan and abuse policies.

10. Third‑Party & Customer‑Provided Software

Use of third‑party software, plugins, scripts, or themes is at your own risk. You are responsible for licensing and updates. We are not liable for conflicts or vulnerabilities introduced by third‑party components.

11. Intellectual Property

  • We and our licensors retain all rights in our platform, software, branding, and documentation.
  • You retain ownership of your content and grant us a non‑exclusive license to store, transmit, and process it to deliver the Services.

12. Warranties & Disclaimers

Except as expressly stated, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

13. Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or business.
  • Our aggregate liability for any claim arising out of or relating to the Services shall not exceed the amounts paid by you to us for the affected Service in the 12 months preceding the event giving rise to the claim.

14. Suspension & Termination

  • We may suspend or terminate Services immediately for non‑payment, AUP violations, legal requests, or risks to platform integrity or other customers.
  • You may cancel at any time via the client portal. Upon termination, data may be permanently deleted.

15. Changes to the Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest revision. Continued use after changes constitutes acceptance.

16. Governing Law & Dispute Resolution

Placeholder: Choose one jurisdiction (e.g., Republic of Albania, or another) for governing law and venue. Consider adding mandatory arbitration or mediation if desired.

17. Notices & Contact

  • Official notices to us must be sent to support@ingenhost.com and via the client portal.
  • Notices to you may be sent to the primary email in your account or posted in the client portal.

18. Miscellaneous

  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign this Agreement without our consent; we may assign to an affiliate or in connection with a merger or sale.
  • Entire Agreement: These Terms, plus any order, SLA, or policy referenced herein, constitute the entire agreement regarding the Services.
